Article 1 - Fields of application and modification of the GCS
The general conditions of sale defined on this page apply to all orders placed on the website www.hydroponics-store.us
The applicable General Terms and Conditions of Sale are those in force at the time of the order.
Article 2 - Price
The prices of our products are indicated in dollars ($) including all taxes (VAT and other taxes applicable on the day of the order) EXCEPT customs fees which, if they occur - are at the buyer's expense and excluding processing and shipping costs.
In case of an order to a country other than metropolitan France, you are the importer of the product(s) concerned. Customs duties or other local taxes or import duties or state taxes may be payable. These rights and sums are not under the jurisdiction of Hydroponics-store.us. They will be at your charge and are your entire responsibility, both in terms of declarations and payments to the authorities and competent bodies in your country. We advise you to inquire about these aspects with your local authorities.
The currency used to finalize the transaction will be the euro (€).
Hydroponics-Store.us reserves the right to modify its prices at any time, but the product will be invoiced on the basis of the rate in force at the time of the validation of the order and subject to availability.
Attention: as soon as you take physical possession of the ordered products, the risks of loss or damage of the products are transferred to you.
Article 3 - Orders
You can place an order on the Internet www.hydroponics-store.us
The contractual information is presented in French language and will be confirmed at the latest at the time of the validation of your order.
Hydroponics-Store.us reserves the right not to register a payment, and not to confirm an order for any reason whatsoever, and more particularly in case of supply problem, or in case of difficulty concerning the received order.
Article 4 - Validation of your order
Any order made on the site www.hydroponics-store.us by the consumer by a "double click" constitutes an irrevocable acceptance which can be called into question only within the limits provided in these general conditions of sale.
The "double click" associated with the procedure of authentication and non-repudiation and the protection of the integrity of messages constitutes an electronic signature. This electronic signature has the same value between the parties as a handwritten signature. Before each order, the consumer is required to accept these GTC.
All the data provided and the recorded confirmation will be worth proof of the transaction.
You declare to have perfect knowledge of it.
The order confirmation will be worth signature and acceptance of the operations carried out.
A summary of the information of your order and these General Conditions, will be communicated to you via the e-mail address of confirmation of your order.
Article 5 - Terms of Payment and Security
The fact of validating your order implies for you the obligation to pay the price indicated.
The payment of your purchases is carried out by transfer thanks to the protected system STRIPE.
The debit of the card is made according to the chosen payment service.
For your convenience, we only accept credit card payments.
Article 6 - Withdrawal
In accordance with the provisions of Article L.121-21 of the Consumer Code, you have a withdrawal period of 14 days from receipt of your products to exercise your right of withdrawal without having to justify your reasons or pay a penalty.
Returns must be made in their original condition and complete (packaging, accessories, instructions). In this context, your responsibility is engaged. Any damage suffered by the product on this occasion may be of a nature to defeat the right of withdrawal.
In case of exercise of the right of withdrawal, Hydroponics-Store.us will proceed to the reimbursement of the sums paid, within 14 days following the notification of your request and via the same means of payment as the one used during the order.
EXCEPTIONS TO THE RIGHT OF WITHDRAWAL
In accordance with the provisions of Article L.121-21-8 of the Consumer Code, the right of withdrawal does not apply:
The supply of services fully executed before the end of the withdrawal period and whose execution has begun after prior express agreement of the consumer and express waiver of his right of withdrawal;
The supply of goods or services whose price depends on fluctuations in the financial market beyond the control of the trader and likely to occur during the withdrawal period;
The supply of goods made to the specifications of the consumer or clearly personalized;
The supply of goods likely to deteriorate or expire quickly;
The supply of goods which have been unsealed by the consumer after delivery and which cannot be returned for reasons of hygiene or health protection;
The supply of goods which, after being delivered and by their nature, are indissociably mixed with other articles.
Article 7 - Availability
Our products are offered as long as they are visible on the site www.Hydroponics-Store.us and within the limits of available stocks. The mention "Out of stock" refers to an out-of-stock condition, our site sells its articles only when they are available.
In case of unavailability of your product after placing your order, we will inform you by email. Your order will be automatically cancelled and no debit will be made. Otherwise, the sums involved will be refunded within 14 days.
Article 8 - Shipping and Delivery
The products are delivered to the delivery address indicated during the ordering process, within the time indicated on the order validation page.
In case of delay in shipping, an email will be sent to you to inform you of a possible consequence on the delivery time that has been indicated.
Article 9 - Warranty
In accordance with Article L. 217-4 of the Consumer Code, you have a legal guarantee of two years following the delivery of your product to inform us of its non-conformity.
The following products are concerned (falling under the category "appliances, with an electric or thermal engine, intended for DIY or gardening" described in article D211-1 of the Consumer Code):
High End™ Hydroponic Growing System;
Hydroponic™ Growing System;
Hydroponic Growing Kit™;
Hydroponic™ PH Tester Pen.
This non-conformity must not be the result of misuse/handling by the buyer, and Hydroponics-Store.us reserves the right to disclaim responsibility in the following cases:
- Product that has been improperly installed or adjusted according to the installation manual;
- Product deteriorated voluntarily or involuntarily by the buyer;
- Product that has been modified and/or attempted to be repaired outside of Hydroponics-Store.us' support;
- Product deteriorated during delivery (in this case, a request for reimbursement must be made within 14 days following delivery).
- It is up to the consumer to prove that the defects and/or irregularities noted on the product(s) are due to Hydroponics-Store.us and its co-contractors and that they are not due to him/her, which would lead to an exoneration of Hydroponics-Store.us' responsibility as mentioned in the previous paragraph.
Proof of the defect or irregularity may be provided by any means by the consumer to Hydroponics-Store, ensuring that the means used allow the defect or irregularity to be clearly identified.
The products must be returned to us in the state in which you received them with all the elements (accessories, packaging, instructions...). The shipping costs will be reimbursed to you on the basis of the invoiced rate and the return costs will be reimbursed to you on presentation of the receipts.
Article 12 - Disputes
Any dispute in connection with the use of the site www.hydroponics-store.us is subject to French law. The competent courts of Paris have exclusive jurisdiction.
INTELLECTUAL PROPERTY AND COUNTERFEIT
Hydroponics-Store is the owner of the intellectual property rights or holds the rights of use on all the elements accessible on the site, in particular the texts, images, graphics, logos, icons, sounds, software. Any reproduction, representation, modification, publication, adaptation of all or part of the elements of the site, whatever the means or the process used, is forbidden, except with the prior written authorization of Hydroponics-Store.
Any unauthorized exploitation of the site or of any of the elements it contains will be considered as constituting an infringement and will be prosecuted in accordance with the provisions of articles L.335-2 and following of the Intellectual Property Code.
